FOOD TRUCK VENDOR APPLICATION
Section 1. Right to use space
APPLICATION FEE: a $500.00 Site Fee is required with All Application Submissions for Food Truck Vendors. Submitting an application does not guaranteeacceptance or attendance at this year’sfestival. FULL SITE FEE PAYMENT IS REQUIRED AND DUE AT THE TIME OF FILING THIS APPLICATION. IF YOU ARE NOT ACCEPTED INTO THE FESTIVAL, YOUR APPLICATION FEE WILL BE IMMEDIATELY REFUDED. ONCE YOUR VENDING SERVICES ARE ACCEPTED AND APPROVED, YOUR DEPOSIT IS NONREFUNDABLE. REFUNDS ARE NOT APPLICABLE IN CASES OF NATURAL WEATHER CONDITIONS OR ANOMOLIES BEYOND THE CONTROL OF THE EVENT PROMOTERS, THEIR SPONSOR OR ANY AFFILIATE. BY SUBMITTING PAYMENT, YOU HEREBY AGREE TO ALL TERMS SET WITHIN THIS APPLICATION FORM. PAYMENTS MAY BE SUBMITTED VIA OUR SECURED WEBSITE:
All required supplemental documents must be submitted prior to vendor approval. Following the receipt of the site fee, City of Chicago Permit, Certificate of Insurance and all supplemental documents, Little Black Pearl Workshop will grant food vendor the right to utilize space in accordance with all applicable state and city laws and the terms set forth below.
Section 2. Laws and it permits
a. All food vendors must comply with all local, state and federal applicable laws.
b. All food vendors are responsible for obtaining all required business licenses, permits and taxes for operation.
c. All food vendors must submit all the supplementary documents as requested in the application instructions.
Section 3. Write to space: Vendors
a) Only fully licensed and insured food truck vendors will be allowed to sell food on Pearl Fest grounds.
b) The right granted to use for vendor space is non-transferable.
c) There are no warranties of guarantees. The event is a rain or shine event. No refunds shall be granted once application is accepted and acceptance confirmed. Acts of God, terrorism or war resulting in the cancellation of the event will not warrant a refund.
d) Food trucks must park in the space designed and assigned to them. All vendors must stay within the bounds of the allocated space. All vendor spaces will be assigned prior to Festival date in an email communication.
e) Vendors are not allowed to relocate without prior Promoter approval.
f) No vendor may utilize amplified sound without prior consent.
g) All vendors must be set up and ready by 10:00 AM and vacate premises no more than two hours after the event has ended at 10:00 PM. Furthermore, vendors may not vacate premises until the Festival ends at 10:00 PM
h) Only food trucks are allowed with-in the event area after 10:00 AM until 10:30 PM. NO EXCEPTIONS.
i) All vendors must remove trash before departing event; and dump bagged trash into proper Festival trash receptacles or locations. A $300Park District fine is imposed on any and all trash remaining.
j) No hot coals may be dumped into Festival trash receptacles or locations until they are cool to the touch: as fire may result. A $1500Park District fine will be imposed on any infractions
l) Food Vendors are responsible for protecting the natural landscaping & path areas with tarp or ground cover to prevent damage to paths of landscape.
Section 4. Merchandise: Barred items
a. Little Black Pearl Workshop and its agents, employees, representatives reserve the right to inspect all vendors merchandise and food setups to ensure as specified in application item to be sold.
b. No vendor may sell any items prohibited by City of Chicago or State of Illinois law such as baby formula, narcotics, pharmaceutical drugs and the like.
c. No vendor may sell counterfeit and or stolen merchandise.
Section 5. Indemnification and release
a. Vendors release and hold harmless Little Black Pearl Workshop, Chicago Park District, City of Chicago and MINI of Chicago and their agents, sponsors, employees, volunteers, venue, and representatives from any and all claims resulting from harm, damage and/or losses associated with Pearl Fest 2019 or actions of the vendor.
Section 6. Advertising
a. All advertising by vendors must be done at vendor’s expense and must be submitted for written permission from Little Black Pearl Workshop prior to production and distribution.
Sections 7. Revocation of selling privileges: termination and litigation
a. Any vendor who evades payment any and all applicable fees, fines or the likes – by designated date - will result in termination of contract.
b. Pearl Fest 2019 is a multicultural event and no form of discrimination is acceptable: any such acts will result in the termination of this contract.
c. Any vendor misrepresentation of products or giving false information of the product type, consistency, origin, condition or quality or range is subject to termination of his contract.
d. Any vendor who fails to comply with any federal, state and/or local laws will result in immediate termination of the contract and may result in legal action.
e. Pearl Fest 2019 reserves the right to modify any and all rules, conditions, time frames and notifications with a written notice to vendor.
Section 8. Set-up Instructions
a. The Pearl Fest Committee will began set up at 4:00 AM - the morning of the event. Food vendors load in schedules will be provided by August 10, 2019. The Pearl Fest Committee will provide a schedule of staggered arrival times to assist in an easy and effective load in anditload-out. All vendors must be ready for health inspections by 10:00 AM. The gates open to the public at 11:00 AM
LIABILITY INSURANCE: Vendor is required – at its sole cost and expense – to carry and maintain, for the mutual benefit of itself, the City of Chicago, Chicago Park District, Little Black Pearl Workshop, and MINI of Chicago, their Board of Directors, their officers, agents, employees and affiliates, a policy of general liability insurance against claims for personal injury, wrongful death and property damage occurring on or about the premises with minimum amount of coverage of $1 million ($1,000,000) per occurrence, on account of bodily injury and/or death of one person and/or on account of damage to property. Vendor agrees to submit a copy of said policy or policies (or certificates thereof) to Little Black Pearl Workshop and Chicago Park District 25 days prior to the date of Pearl Fest. On the Certificate of Insurance, Little Black Pearl Workshop and the City of Chicago are to named as additional insured. Such policy of insurance shall be ensured by an insurance company reasonably acceptable to Little Black Pearl Workshop, the City of Chicago and the Chicago Park District; and it shall bear an endorsement to the effect that the insurer agrees to notify Little Black Pearl Workshop and Chicago Park District not less than 10 days in advance of any modification or cancellation thereof.
INDEMNIFICATION: Vendor shall indemnify and save and hold harmless Little Black Pearl Workshop, Chicago Park District, and the City of Chicago, its Board of Directors and its officers, agents and employees from and against any and all loss, liability, damage, cost and expense, including but not limited to reasonable attorney fees, injury, death, loss or damage of whatever nature to any person, property or any other claim by vendor or its officers, employees, agents, customers, licensees, invitees or any other person, firm or corporation resulting from the occupancy of the event space. This indemnification shall not extend to any loss, liability, damage, cost or expense caused by the act or omission of little black Pearl Workshop, Chicago Park District, City of Chicago, or MINI of Chicago and its Board of Directors and their respective officers, agents and employees.
